taken on record and marked as Exh.08. On behalf of defendant
No. 1 Adv. Sidhesh Sutar h/f. Adv. Vinod Naik has given no
objection for allowing the withdrawal of suit. None on behalf
of defendant No. 2 is present. Both the plaintiffs are
unconditionally withdrawing the suit against defendants so I
do not feel any legal hurdle in allowing the application as
prayed. With this, in the result following order is passed.
ORDER 1. The application ( Exh. 08) is allowed as prayed. 2.
Suit No. 743 of 2018 is hereby withdrawn cum dismissed for
want of prosecution. 3. Court fees be refunded to the plaintiffs
if they entitled for the same as per rules. 4. Bill of cost be
drawn accordingly.
