The NM no. 577/25 is filed for condonation of delay to take the written statement on record alongwith WS. It is submitted that, order was passed on 11/06/2019 and the defendant no. 1 is 84 years old and cannot communicate properly. From 2019, due to Covid- Pandemic he could not connect with his advocate. It is mentioned that, earlier advocate has also not communicated the dates of the matter. Therefore could not take any action to set aside the order. It is mentioned that, in the month of November, he came to know about the legal proceeding and matter is proceeded without WS. Hence, appointed new advocate and filed the present NM.
Plaintiff strongly opposed the NM contending that there is delay of 2095 days, no grounds are made out to condone the delay hence, prayed for rejection of the same with heavy costs.
Heard Advocate for deft. no. 1 and plaintiff. It is not dispute that, order was passed on 11/06/19 and thereafter there was Covid-19 Pandemic therefore, it is acceptable point that, due to Covid-19, the defendant no. 1 may not have approached the advocate. The age of the defendant no. 1 is 84 years and considering the old age the reason stated by the defendant no. 1 sound reasonable. Therefore, this court is of the view that, considering the nature of suit and in the interest of justice the delay needs to be condone. There is huge delay hence, delay is condoned subject to costs of Rs. 3000/- payable to the plaintiff. On depositing costs WS be taken on record.
