ORAL ORDER
1) The chamber summons is filed by official liquidator
to amend the plaint on the ground that the plaintiff company
went into liquidation and official liquidator is appointed. The
chamber summons is supported by affidavit of Sanjay Kumar
Agarwal the official liquidator of plaintiff company.
2) Advocate for defendant stated that the amendment
is a formal amendment therefore, appropriate order be passed.
3) I have gone through the affidavit in support of
chamber summons. The xerox copy of the order of National
Company Law Tribunal in MA no.15252018 in CP No.

(IB)1514(MB)/2017 is filed on record. In tis case the official
liquidator is appointed. Therefore, the amendment is necessary as
the plaintiff company is went into liquidation. Hence, pass
following order:
ORDER
1. The prayer (a) of chamber summons
is made absolute.
2. The applicant to carryout necessary
amendment in the plaint within
limitation.
3. Accordingly the chamber summons is
disposed of.
