It appears from the record that the Advocate for the plaintiff published the Writ of Summons in the name of defendant without the Order -- 1 of 3 -- :2: Chamber Summons No.481/2018 in Suit No.2914/2017 of the Court. Therefore, the paper publication which is placed on record cannot be considered as a service on the defendant as the publication is without the Order of the Court. Ld. Advocate Mandira Dey for the plaintiff submitted that ‘Free Press Journal’ and ‘Navshakti' are having the circulation at Mulund, Mumbai, therefore, Writ of Summons in the name of defendant Nos. 1 and 2 be published in the above mentioned daily news papers.
