After arguing appeal for some time, Mr. Tamboly, the learned counsel appearing tfor respondent/Defendant, after taking instructions from his client, makes a statement that the respondent would shift the decities in the temple to Wagheshwari temple within a period of two months from today. Mr. Tamboly fruther makes statement that respondent would reconstruct a new Hanuman temple during the process of development of entire land. Both the statements made by Mr. Tanboly are recorded and accepted as underaking given to the Court.
In view of the arrangements so made, nothing survives in the present appeal. The appeal is disposed of. Since the appeal is disposed of, nothing survives in interim application and it is also disposed of.
