Plaintiff is present along with his counsel. Defendant No.2 is
present along with her counsel. Defendant No. 1 is absent.
This matter was referred for mediation. The mediation report
is at Exh-12. The matter is settled between the parties in
view of consent terms filed at Exh-13. The mediation report
is read and recorded. Plaintiff and defendant No.2 have
admitted contents in the consent terms at Exh-13. Plaintiff
has agreed to accept an amount of Rs.2,28,600/- towards full
and final settlement in installments as mentioned in the
consent terms at Exh-13. Hence, I proceed to pass following
order:-
Order
1. Sum. Suit No. 471 of 2021 is disposed of as settled
between the parties, in view of consent terms at Exh-
13 before mediator.
2. Accordingly, decree may be passed. Consent terms at
Exh-13 shall form part ofdecree.
3. Plaintiff is entitled for refund of court fees as per rules,
if any, provided for.
4. Pending summons for judgment No.75/2021 is
disposed of accordingly.
5. Sum. Suit No.471 of 2021 is disposed of accordingly.
