ORDER
Applicant/accused is charge sheeted for the offence
punishable u/s. 399, 402 of I.P.C. r/w.4,25 of Indian Arms Act.r/w.
37(1)(a),135 of Bombay Police Act registered in C.R.No.628/16.
2. Perused application and say filed by prosecution.
3. Heard Ld.advocate Shri.Arjun Lingalod for the
applicant/accused and Ld.APP Ms.Raykar for the State/Respondent.

4. The Ld.advocate for the applicant submitted that applicant
is innocent and falsely implicated in the case. He was returning to his
home after his labour work but the police has implicated him falsely.
Applicant has no concerned with the alleged seized goods. Entire family
of the applicant is dependent on him as he is in jail. His family is facing
the starvation, hence, prays that applicant be released on bail.
5. I have perused the FIR. Nylon rope and one black colour
mobile was seized from the possession of applicant/accused. There was
no explanation for what purpose he was carrying out the nylon rope
with him. Therefore, the submission of Ld.advocate for the applicant is
not found to be correct. On the other hand, Ld.APP submitted that if the
applicant released on bail again he will commit the same nature of
offence. Therefore, he should not be released on bail.
6. As such, there is no grounds made out by the applicant to
release him on bail. Hence, I proceed to pass following order.
ORDER
Bail application vide Exh.3 stands rejected.
