Heard both the Ld. Adv. for plaintiff and defendant on NM
No.3885/2017.
At this juncture the Ld. Adv. for plaintiff make a statement that, if
the defendant gave undertaking that he is not going to alter the
basic nature of existing suit premises then it would be suffice to
dispose off the NM. At the same time, she also make a statement
that she has no objection if the defendant carry out repair work
whichever is necessary so as to protect and preserve the suit
premises.
The Ld. Adv. for defendant also gave undertaking that except
carrying out permissible repair work the defendant will not alter
the basic structure of the suit premises. Hence, in view of
submissions of both the sides, the NM No.3885/2017 stands
dispose off in view of submission of both the sides.
Parties to take a note of it.
