In this NM Defendant has sought restoration of possession over suit premises contending that previously it was possessed by Defendant and Plaintiff has illegally took its possession even though some other  tenants has right to possess said flat. According to Defendant\''s advocate, society has right to possess the flat in question till the tenant who is actually entitled comes forward.  It is argued that Defendant was having possession over suit flat and Plaintiff has taken forcible possession therefore, Defendant is seeking restoration of possession of suit flat till pendency of the suit.  At this juncture court raised query that if really Defendant was dispossessed on 22/12/2012, what is the time limit to seek the status quo ante or to seek restoration of possession as provided by Specific Relief Act.  Thereupon Defendant\''s advocate submitted that on next date he will satisfy the Court on the point of limitation.

Advocate for Plaintiff argued that Plaintiff is owner of the suit premises in the agreement executed in favour of the society room nos.8,11 and 12 were excluded saying that tenants from those rooms should decide the dispute between landlord and tenants and thereafter landlord should inform society that who should become member of society in respect of those rooms.  Plaintiff\''s advocate referred agreement Exh.A, indenture Exh.B, affidavit of Defendant Exh.C, the letter dated 18/05/2009 sent by Society to Khodidas Kothari the previous tenant of Plaintiff\''s husband and by referring all those documents it is argued by Plaintiff that Defendant has no right to claim possession of suit premises which is admittedly owned by Plaintiff.  Hence, according to Plaintiff\''s advocate, Notice of Motion is necessary to be dismissed.

At the time of arguments it is noticed that Notice of Motion no.1296/19 filed by Plaintiff on 25/03/2019 is pending and same reliefs as claimed in Notice of Motion no.4146/16 are claimed in Notice of Motion no.1296/19.  In such circumstances Plaintiff advocate is directed to point out that as to how second NM for same relief is maintainable.  It is noticed by me that even though in roznama dated 23/10/2018 it is mentioned that Notice of Motion no.4146/16 is already disposed off by order dated 28/08/2018, there is no order in the roznama dated 28/08/2018 to show that Notice of Motion no.4146/16 is disposed off on the contrary there is order to the effect that Notice of Motion no.4145/16 which was filed by Plaintiff for condonation of delay in filing review petition is disposed off because of the fact that review petition is disposed off and hence said Notice of Motion could not survive.  As such it becomes clear that NM no.4146/16 is yet to be decided and hence it becomes clear that in roznama dated 23/10/2018 it is wrongly mentioned that NM no.4146/16 is disposed off.
