Heard Plaintiff\''s advocate about NM No.1290/193. He submitted that on 21/02/2019 letter of administration with Will which is filed at page no.17 of NM is granted by Hon\''ble High Court in favour of Plaintiff. Further, it is argued that Plaintiff was suffering from Cancer and medical certificate to that effect is also filed on record. It is further argued that letter issued by Co-op. Court Mumbai in respect of case no.ABN/838/2294 of 1978 and it is informed under RTI that no such case was found to be registered with said Court. About documents filed at page no.29 to 39 of affidavit of NM it is argued that those documents are traced out after Plaintiff has recovered from Cancer. Lastly it is argued that Plaintiff is intending to bring on record those documents and therefore NM is necessary to be made absolute.
It is made clear that if on next date Defendants will not argue NM, court will be compelled to decide NM on merits considering reply filed by Defendant no.5 as shown in roznama dated 09/04/2019.
