Heard counsels of parties.
Chamber summons is taken out to correct the name of defendant no.1
in cause title by substituting word “Development” in place of word
“Developers”. Although defendants have objected to chamber
summons but I am of the view that proposed amendment is to correct
error committed by the Plaintiffs in carrying out amendment in
pursuance to order dtd.22.06.2018 passed in Chamber summons
no.867/18. The proposed amendment is of formal nature and to
rectify error committed while carrying out amendment. So, chamber
summons deserves to be allowed. Hence, pass following order.
ORDER
1. Chamber summons No.658 of 2019 is allowed and made absolute
in terms of prayer clause (a).
2. Plaintiffs have to carry out amendment within period of two weeks
from the date of order.
Accordingly, Ch/s no.658/19 is disposed off.
