It also appears that, plaintiffs have taken out Contempt notice of motion no. 625/2021 for punishing Contemnors for committing breach of order dt. 13/03/2020 in Notice of Motion no. 1189/2020.
      Ld. Advocate for defendant no. 07 and 08 had submitted that, as the Notice of Motion no. 1059/2021 is taken out under Order 7 Rule 11 of CPC, it will have to be heard and decided first by the court before proceeding with the trial or any other Notice of Motion. On the other hand, ld. Advocate for plaintiffs had submitted that, Contempt Notice of Motion no. 625/2021 will have to be heard and decided first and submitted that, plaintiffs will produce citations in support of same.      Heard arguments advanced by ld. Advocate for defendant no. 07 and 08 on the above point. Court has gone through the observations made therein.
     From the record it appears that, defendant no. 07 and 08 have taken out Notice of Motion no. 1059/2021 for rejection of plaint Under Order 7 Rule 11 (a) of the Code Of Civil Procedure on the ground that, plaint does not disclose any cause of action. On the other hand, plaintiffs have taken out Contempt Notice of Motion no. 625/2021 for punishing the contempnors for committing breach of Order dt. 13/03/2020 in Notice of Motion no. 1189/2020.
     The object of Order 7 Rule 11 of CPC is to ensure that, suit which discloses no cause of action or is otherwise barred in law is brought to an end at threshold. In the case of  R. K. ROJA Vs.  U. S. RAYUDU AND ANOTHER cited supra relied by defendant no. 07 and 08. Hon\''ble Appex Court observed that, \''Once an application is filed under Order 7 Rule 11 CPC, the court has to dispose of same before proceeding with the trial. There is no point or sense in proceeding with the trial of the case, in case plaint is to be rejected at the threshold.\'' Moreover, the real object of Order 7 Rule 11 is to keep out of court, irresponsible law suit. Order 7 Rule 11 of CPC casts a duty on the court to perform its obligations in rejecting the plaint when same is hit by any of the infirmities provided in clauses of Order 7 Rule 11 of CPC, even without intervention of the defendant. Therefore, Considering the observations in the citations relied by defendant no. 7 and 8 cited supra and object of provision of Order 7 Rule 11, there appear substance in the contention of defendant no. 7 and 8 that, as they have taken out Notice of Motion no. 1059/2011 for rejection of plaint Under Order 7 Rule 11 of CPC, court has to dispose of same before proceeding with the trial.
     On the other hand, Contempt proceeding is an independent proceeding. It may continue even after disposal of the suit. Plaintiffs have not brought on record any material to substantiate their contention that, Contempt Notice of Motion is required to be heard and decided first before proceeding with the Notice of Motion for rejection of plaint or trial of the suit. Considering the above fact and nature of the Contempt proceeding there appear no substance in the contention of plaintiffs that, Contempt Notice of Motion no. 625/2021 is required by law to be heard and decided first.
      Considering matter on record and above discussion, court hold that, in the present matter Notice of Motion no. 1059/2021 for rejection of plaint Under Order 7 Rule 11 of CPC is required to be heard and decided first. Hence, the following order.

     As per plaintiff in the Appeal From Order having Stamp No. 10297/2023 inspite of efforts, plaintiff did not get circulation for obtaining the necessary order of stay. From the record it appears that, on the last date, time till this date was given to the plaintiff. As per the order dt. 16/02/23 in Appeal From Order No. 816/2022, it appears that, Notice of Motion no. 1059/2021 is directed to be disposed of at earliest and preferably within 6 months.
