Heard Mr. Kudalkar who has submitted that on 02.04.2018 Court has directed defendant to consider the reply tendered by plaintiff to the disputed notice and thereafter pass speaking order by giving period for compliance to plaintiff as per law.  It is submitted that said speaking order is passed on 21.09.2018 and Chs/ No. 1750/18 is taken out by plaintiff on 24.09.2018.  Plaintiff has also taken out Nm No. 3615/18.   It is argued that reply of Nm is filed but reply to Chs is not filed by BMC.   However on 29.03.2019 officer came to the suit premises and gave threats to demolish suit premises.  Hence plaintiff has apprehension that in the pendency of Chs and Nm officer of defendant will demolish suit premises.  Therefore ad interim relief is necessary to be granted to protect suit premises.
     Advocate Mrs Chavan submitted that speaking order is passed on 21.09.2018, plaintiff has taken out Chs No. 1750/18 on 24.09.2018 and that time plaintiff has not pressed ad interim relief.   She has also pointed out that reply to Notice of Motion no. 3615/18 is filed by defendant/BMC and hence ad interim relief should not be granted.
     Considering the fact that by order dated 02.04.2018 Court has granted protection of suit premises and directed BMC to pass speaking order by considering reply to the notice filed by plaintiff.  I find that notice structure can be protected at least till 01.04.2019 so that parties can argued Nm No. 3615/2018 on merits  and Court can pass order about said Notice of Motion on merits and thereafter parties can proceed as per Order  passed by Court.  Hence ad interim  relief in terms of prayer clause (a) of Nm No. 3615/18 is granted till 01.04.2019.

                               ORDER
1.  Chamber Summons no.1750/2018 is made absolute in terms of prayer clause (a).
2. Plaintiff is directed to carry out proposed amendment in the plaint within stipulated period provided by law.
3.  Plaintiff is further directed to file typed copy of amended plaint before the Court and to serve its copy upon Defendant/BMC.
Heard arguments in respect of NM 3615/2018.  Learned advocate for Plaintiff referred the copy of letter Exh.N filed at page no.32 of the plaint and submitted that, by said letter BMC has informed Plaintiff that suit premises was going to be affected by the road widening of Khot road and therefore Plaintiff should produce the documents for determining his eligibility for permanent alternate accommodation.  It is argued that accordingly Plaintiff has filed 19 documents however all of sudden disputed notice Exh.P which is at page no.34 of the plaint came to be issued.  Learned advocate for Plaintiff also referred other documents filed with plaint and submitted that, NM is necessary to be made absolute.
BMC advocate Ms. Tondwalkar referred BMC circular dated 20/03/2017 in respect of bottle-neck policy and she has referred point no.8 of said circular.  Clause (a) of said point no.8 provides that notice u/s 314 of BMC Act can be issued for PAP tenements, however clause (b) of said point no.8 provides that the documents submitted by affected structure holders shall be scrutinized by concerned ward staff as per prevailing policy and appropriate orders shall be passed and communicated to the party.
At this juncture, Court asked BMC officer Mr. Mayur Kardile, Jr. Engineer who is present in the Court that whether compliance of clause (b) of point no.8 of said circular is made on perusal of circular of BMC dated 25/02/2004 related to bottle neck policy. It is noticed that in said circular the detailed procedure of applying bottle-neck policy is given in said circular. In such circumstances BMC is directed to informed to the court on next date that whether Plaintiffs eligibility for permanent alternate accommodation under bottle neck policy is decided or not after considering such submission court will decide NM on merits.
