ORAL ORDER
This chamber summon is taken out by the plaintiff
for seeking permission to carry out necessary amendment in the
Suit for changing the name of the Plaintiff Bank as per
schedule.
2. Read chamber summons, reply and documents filed
on record. Heard both sides.
3. This is a suit for recovery of amount of Rs.3,52,441/-
towards education loan. The suit was initially instituted in the

name of ‘Vijaya Bank’ in the year 2012. As per notification in
official gazette dated 02.01.2019, Vijaya Bank (plaintiff) and
Dena Bank has been merged in Bank of Baroda under
amalgamation of Vijaya Bank and Dena Bank with Bank of
Baroda scheme 2019. Proposed amendment does not change
the nature of the suit and also does not constitute new cause of
action. The change in the name of plaintiff Company is a
subsequent event. Hence, bar providing under proviso of Order
VI Rule 17 of the Code of Civil Procedure, 1908 is not attracted.
Accordingly, I proceed to pass following order.
ORDER
1. Chamber Summons No.490 of 2020 is made absolute in
terms of prayer clause (a) & (b).
2. Plaintiff is permitted to carry out amendment as per
schedule within 14 days from the date of this order and
file amended plaint within statutory period.
3. Chamber Summons No.490 of 2020 is disposed off.
