Adv. Kudalkar for plaintiff. Adv. Chandramore for BMC with Mr. V.P. Sakharkar, Sub- Engineer, D Ward are present.
According to Mr. Sakharkar the corporation has received the reply dtd. 01.09.2017 issued by the plaintiff on 07.09.2017. According to him the reply is under consideration. He further submits that the order will be passed within 15 days. He further submits that if required personal hearing will be given to the plaintiff and order will be communicated by following due process of law. Adv. Kudalkar submits that if any adverse order is passed, the plaintiff may be given protection for 15 days before taking any action of demolition. Mr. Sakharkar submits that if any adverse order is passed, 15 days time will be given to the plaintiff prior to demolition and prosecution. His statement is accepted and taken on record.
Adv. Kudalkar for plaintiff submits that in the circumstances the plaintiff be allowed to withdraw the suit unconditionally. Accordingly the suit is disposed off as withdrawn. The NM is also disposed off. The plaintiff to register the suit and NM for statistical purposes. Ordinary copy of this order duly authenticated by Sheristedar of this Court be supplied to both the parties.
