This N/M is taken out by deft. praying to
condone delay of 5 days for appearing
before the Court. It is contended in the
N/M that deft. has received the summons
on 12.07.2019. However, on that day, Legal
Head of the deft. was traveling for office
work and therefore, advocate could not be
appointed. The Legal Head of the deft.
resumed office on 22.07.2019 and
appointed an advocate on 24.07.2019. The
advocate for deft. attempted to file
vakalatnama on 25.07.2019. But, he could
not file vakalatnama in the Court as the
Court was not presiding on that day at
02.45 pm. and therefore, vakalatnama was
filed on 26.07.2019. It is submitted that
deft. has made out sufficient cause for delay
in making appearance before the Court. In
reply, plaintiff submitted that deft. has not
given sufficient reason for delay in making
appearance before the Court. Record shows
that advocate for deft. filed the
vakalatnama by taking out preceipe on
26.07.2019. It is submitted on behalf of
deft. that summons were served on
12.07.2019. Deft. was required to appear
before the Court on or before 22.07.2019
but he appeared on 26.07.2019. Deft. has
given sufficient cause for delay of 5 days in
appearing before the Court. Hence,
following order. ORDER 1. N/M
No.1154/20 is made absolute in terms of
prayer clause (a). 2. No order as to costs. 3.
N/M No.1154/20 is disposed of
