        Perused notice of motion and affidavit in support thereof. Plaintiff did not file his reply to this notice of motion. It appears from affidavit of service and track reports filed on 04.02.2021 that defendants The Sub Post Master and The Senior Suprintendent were served on 22.01.2022. But order to proceed without reply of defendants was passed on 22.07.2022. Thereafter this notice of motion was taken to set aside that order. Defendants stated in their affidavit that papers were sent to Ministry of Law and Justice for appointment of advocate to represent them. The department of Law and Justice by letter dated 26.09.2022 intimated engagement of standing counsel to represet them. Thereafter papers were given to the standing counsel and then they appeared in this matter.
            Affidavit of defendants show that there is delay due to official procedure for appointment of standing counsel. Plaintiff can be compensated by awarding suitable cost. No prejudice will be caused to plaintiff. Hence, following order is passed
ORDER
1. Notice of Motion No.4615/2022 is allowed subject to cost of Rs.1,000/-.
