Business : This Notice of Motion has been taken out by the plaintiff for
discharge Court Receiver, High Court Bombay appointed as
per order dtd.19.07.1994 with regard to Flat No.403. Perused
affidavit in support. It appears that this suit has been filed by
the plaintiff in respect of Flat no.502. During the pendency of
the suit, the plff., Deft. Nos. 1 to 3 and Deft. Nos.8 (a) to 8(c)
arrived at settlement and deft. Nos.1 and 2 have agreed to
execute agreement for Sale in respet of flat no.403 instead of
Flat no.502. Deft. Nos. 8(a) to 8(c) have no objection for the
same. In this background, and as parties are at compromise it
is just in the interest of justice to discharge Court Receiver in
respect of Flat no.403 as prayed. Thus, N/M is to be made
absolute in terms of prayer clause (a). With this, I proceed to
pass the following order. ORDER 1. Notice of Motion
No.940/18 is made absolute in terms of prayer clause (a). 2.
Court Receiver is discharged in respect of Flat No.403. 3.
Accordingly N/M No.940/18 stands disposed of.
