ORAL ORDER
This is a motion taken out by defendant to set aside order
of exparte evidence dated 29.01.2019. Perused endorsement given by
plaintiff, raised strong objection and claimed for cost.
2. Heard learned advocate Mr. Vasim Shaikh for defendant at
sufficient length. Learned advocate Mr. I. A. Patel for plaintiff bank
submits that defendant is defaulter in maintenance arrears, even he was
failed to deposit regular maintenance.
3. One perusal of roznama, it appear that defendant is

negligent. He failed to file written statement. However, defendant is
ready with written statement. It would be appropriate to decide the
suit on merit. Hence, the order.
ORDER
1. Order dated 29.01.2019 is set aside, subject to cost of
Rs. 1,000/ be paid to plaintiff on or before next date.
2. Copy on W.S. filed by defendant be exhibited, copy is
served on plaintiff.
3. Notice of Motion no. 1237 of 19 is disposed of accordingly.
