O R D E R
This notice of motion is taken out by the defendant no.1 for
accepting the written statement by setting aside no W.S.Order. This
notice of motion resisted on behalf of the plaintiff by filing his reply.
Heard learned counsels on behalf of both the sides at length. Perused
the record.
2. Both the parties and their advocates are present before me. The
learned counsels on behalf of the plaintiff has submitted that he has no
strong objection for accepting the W.S. filed by the plaintiff by
condoning the delay, subject to imposing some costs. The learned
counsel on behalf of the defendant no.1 has agreed to pay the cost of

Rs. 1,000/. The same is accepted by the learned counsel on behalf of
the plaintiff. Therefore, I inclined to allow this notice of motion. Hence,
I proceed to pass following order.
ORDER
1. Notice of Motion No.1234/19 is hereby allowed subject to cost of
Rs.1000/.
2. The cost of Rs.1000/ be paid to the plaintiff.
3. Notice of Motion No.1234/19 is disposed off accordingly.
