Perused N/m which is supported by an affidavit. Also perused the reply on affidavit filed by the MCGM. Heard Ld.advocates of both the sides. Today the concerned officer of MCGM Mr.Ankush Prabhu, Rent Collector is present and he has made a statement at Bar that before initiating any action against the plaintiffs, the MCGM is ready to follow due process of Law. It is also submitted that the MCGM will be following the rules as envisaged in Chapter V-A of The Mumbai Municipal Corporation Act. In view of the statement made by the concerned Officer of the MCGM, no purpose would be served in keeping the N/m as well as the suit pending. Hence in view of the statement of the MCGM, N/m No.956/2018 stands disposed of with a direction that MCGM to follow the due process of Law before taking any action with regard to the suit premises.
