Advs. Ld. Adv. Haria for defendant submits that the
premises where defendant was running the business came
to be sold in May 2016. Summons was served on said
address, therefore plaintiff could not receive the summons
at proper time. Copy of WS is annexed by defendant, it is
requested to set-a-side the order dtd. 14-02-2020. Ld. Adv.
Karule for plaintiff raised strong objection. It is added that
defendant is playing mischief, it is prayed to reject the
motion. In alternative, prayed for heavy cost. Perused NM
and grounds mentioned in affidavit support. No doubt there
appears to be negligence on the part of defendant to take
follow up, However, it would be appropriate to decide the
suit on merit. Hence, NM No. 1120/20 is allowed, Subject
to cost of Rs. 2,500/- be paid to plaintiff within two weeks.
NM No. 1120/20 is disposed off. Both side to submit list of
witness, draft issues and schedule of case management.
