Today plaintiff and defendant No.3 are present before the Court along
with their respective Advocates. The parties have identified by their
respective Advocates.
2. By way of this application the plaintiff seeking permission for
withdrawal of the suit without any condition on the ground that
compromise took place in between himself and defendant No.3 in terms
settled between them vide Consent Terms (Exh.7). The say of defendant
No.1 and 2/MCGM were also called. It is submitted on behalf of
defendant No.1 and 2/MCGM that, if plaintiff is going to withdraw the
suit unconditionally without seeking relief against defendant No.1 and
2/MCGM then they have no objection to accord permission, otherwise
defendant No.1 and 2/MCGM have strong objection.
3. I have gone through the record and proceeding of this case. It is the
matter of record that, plaintiff is going to withdraw the suit without any
condition. In view of this facts and circumstances, there is no legal
impediment to accord the permission to withdraw the suit as prayed for.
Hence, I pass the following order.
ORDER
1. Application is allowed as per prayer made in para 2 of the application.
2. Suit stands dismissed as withdrawn by the plaintiff without any
condition.
3. In view of disposal of the suit, NM No. 1216 of 2019 does not survive,
accordingly disposed of as withdrawn.
