The defendant No.8 has taken out this Notice of Motion
praying to set aside no reply order dated 14.01.2020 passed against it
and allow it to file reply to the Notice of Motion of the plaintiff bearing
No.3971/2019.
2. The plaintiff in person and the learned advocate for the
defendant No.8 present. They submit that the Notice of Motion filed by
the plaintiff is pending since long and it would be just to hear it on its
merit by allowing that the defendant No.8 to file its reply. They submit
that this Notice of Motion therefore the decided on its merit. The
plaintiff claims cost, in case the Notice of Motion is to be allowed.

3. Considering the nature of the suit and the scope of this
Notice of Motion, it would be just in the interest of the justice to allow
the defendant No.8 to file its reply, which is also to be the written
statement. Under such circumstances, it will not be proper to award
cost. Hence, the following order.
O R D E R
1. Notice of Motion No1082 of 2020 is allowed.
2. The reply-cum-written statement filed by the defendant No.8
along with this Notice of Motion is taken on record.
3 In the circumstance, no order as to cost.
4. Notice of Motion No.1082 of 2020 stands disposed of.
