1. Decree holder has filed this application to direct the Valuer viz. Perfect Valuations and Consultants to withdraw the invoice raised and to submit their revised invoice which was confirmed with Office Executive of Advocate of DH. According to DH during various calls made to valuer, she sought quotation for valuation of the properties without any title documents. The said valuer informed that they shall be charging a sum of Rs.17,500/- for each property along with applicable GST towards professional charges to conduct the valuation of properties with or without title documents and consequently the said valuer confirmed the valuation charges by SMS on her mobile-phone on 24/9/2022.
2. This court has called report from the Sheriff Office. Dy. Sheriff has given report at Exh.I and contended that valuer has submitted his report and invoice of Rs.1,21,000/-. As per invoices submitted by the valuer the scale of fees fixed by the Honble High Court, Bombay, if the valuation of the property is more than Rs.10,00,000/- the maximum fees shall be Rs.1,00,000/- and the valuer has calculated valuation fees as per the said scale of fees.
3. Letter dt.25/1/2023 issued by the said valuer indicate that DH has contacted him. She has vaguely described the properties and insisted to give quotation. She did not give much details, nor any documents. He (valuer) was not aware that the said properties were under litigation. On asking approximate value, she gave a figure of Rs.2 crore, to which he gave quote verbally as Rs.17,500/- + GST subject to final valuation. Thus, the said quote was tentative. The validity of quote is only 15 days. Thereafter, DH kept quite for a very long time.
4. In view of above facts valuer has properly raised invoice as per the scale fixed by Honble High Court, Bombay. Hence, he cannot be directed to withdraw the invoice. Thus, application Exh.H is hereby rejected.

Deputy Sheriff has given say on Exh.J and contended that appropriate order may be passed.
Application (Exh.J) is for police protection in the proceeding of auction of the property. DH contended in the application that owner of respective properties had refused to allow valuer for valuation of the said properties. Hence police security is necessary to complete the auction. Therefore application (Exh.J) is allowed subject to payment of the charges of police protection by the DH.

The applicant in CS is seeking stay to the auction sale, scheduled tomorrow, of the property attached in the Execution proceeding to which the petitioner is claiming stood in her name and has no concern with the JD No.1.
Record shows that she is appearing before Commissioner of Accounts, since 12th April, 2022. The property is attached in the year 2021, the order of auction is issued on 21st April,2022. The applicant is claiming that the JD No.1 and the vendor of the property purchased by applicant are two different persons. The copy of KYC of vendor is missing in the copy of sale deed whereas the KYC of purchaser and witnesses are annexed. To establish the fact that the JD no.1 and Vendor are two different person, the KYC of vendor is necessary. The applicant is seeking liberty to file it at later stage.
Considering the rival contention, I am of the view that the auction sale cannot be stayed at this stage, however, the confirmation of sale may be stayed till decision of sale.
Hence, I proceed to pass following order-
