Heard both on Ch/s. The Respondent has no objection to
allow the chamber summons. But according to Respondent,
it may be added as Defendant No. 2. Perused the Order of
the National Company Law Tribunal dated 07/06/2019
together with scheme approved by the Tribunal. Since the
Defendant company is now merged in the Respondent, it is
necessary take a note in the title clause of the Plaint as well
as in the pleadings where ever it is necessary. The request
to add the Respondent No. 2 as a party Defendant no. 2 can
not accepted. Accordingly, the Chamber Summons No.
462/2020 is allowed. The Plaintiffs to carry out the
necessary amendment as per schedule and submit the
amended Plaint and its copies for other side. While carrying
out such amendment the Plaintiffs shall put a note after the
title of Defendant that Shreenivas Cotton Mills Limited is
merged in Macrotech Developers Limited vide Order of the
NCLT, Mumbai dated 07/06/2019. The Respondent i.e. the
substituted Defendant to remain present on next date
without expecting fresh service of summons. Accordingly,
the Chamber Summons No. 462/2020 is disposed off.
