From the perusal of the record, it would reveal that though
vide order dtd. 09-01-2024 passed in C/S No. 296/2023 this
Court allowed the legal Representatives of the deceased
sole plaintiff Pushpa Devdas Advani to be brought on
record subject to payment of cost of Rs. 1500/- each to the
contesting defendants no. 3,4 and 5 within a period of 4
weeks from the date of said order, the applicants in the said
C/S do not appear to have complied with the said order,
which stipulates that on failure to make payment of such
cost the C/S shall stand refused and the suit abated. In the
result therefore for non compliance of the said order, the
suit stands abated against the defendant and stands disposed
of accordingly.
