Perused the NM which is supported by an affidavit,being executed by General secretary of deft.no.2 Dhunji Naterwalla. It is submitted that the WS is ready in all respect and can be placed on record. Considering the nature of dispute , I am of the opinion that for fair trial and proper adjudication of this case an opportunity needs to be granted to deft no.2 to defend the suit by filing written statement. So for as previous concerned the paragraphs no 4 to 7 of the affidavit in support has satisfactorily explained the reasons for not filing WS within statutory period . Hence in the interest of justice, I pass the following order.
NM no. 4752/19 is allowed and made absolute in terms of prayer clause (a) and (b) with an direction that deft no.2 to file written statement today only on record.
