SU 1019/20 Adv. Ms. Vijayarani Prasad for the plaintiff is present. She informed
the Court that the plaintiff is not in contact to proceed with the
matter and therefore, suitable order may be passed.
Adv. Mr. Khandagale for defendant/MCGM is present.
Order below exhibit No. 01:
01. The record shows that the plaintiff is absent to proceed
further with the matter since last considerable time and therefore,
it is posted for dismissal order. Even, he is not in contact with his
advocate and accordingly, the said statement is made by her. At the
same time, he plaintiff did not comply with the order of this Court
to ensure due service of summons and to comply with the Order od
dated 07.12.2020. Nor, any stay order is communicated on the
record to justify absence of the plaintiff. It is, thus, clear that he is
not interested to proceed further with the suit. In the result, the
suit stands dismissed for want of prosecution vide Order 9, Rule 2,
of the C.P.C., 1908. All the pending applications are filed. He is also
called upon to bear their own costs of litigation. Bill of costs be
drawnup accordingly. The proceeding stands closed.
