Deft.No. 6/State present. Read the Chamber Summons No. 448/2020. No say filed
by the other party. Heard the Ld. Advocates for the plaintiff. The plaintiff filed this
Chamber Summons No. 448/2020 to amend the plaint. He submitted that he has
annexed the schedule and after paragraph no. 33 he added paragraph no. 34a to c.
He submitted that after filing the suit the plaintiff&amp#039s Power of
Attorney have filed RTI application for information and after information he wants
to amend the plaint. The defendant not filed their reply and oppose to amend the
suit. Perusing the amendment it appears that, It will not change the nature of the
suit. But the plaintiff wants to bring on record additional pleading in his plaint.
Considering the nature of amendment, it will better to amend the plaint. If the
plaint is amended the opportunity be given to the defendant to file their written
statement. Therefore, it will better to allow the Chamber Summons No. 448/2020.
Hence, for the interest of justice and to avoid multiplicity of the proceeding the
Chamber Summons No. 448/2020 is hereby allowed subject to cost of Rs.500/ pay
to the defendant. Plaintiff is directed to carry out amendment after payment of cost
before the next date.
