The Plff is challenging notice dated 25/10/2018 purported to be under Sec.351 of MMC Act against unauthorized construction of ground floor structure using brick masonry/GI sheets as walls and AC sheet roofing in area admeasuring 15 x 6.50 mtr. with average hight 4.25 mtr.  According to Ld. Adv. for Plff the structure is in existence since prior to 1962 and the same is reflected in 7/12 extract of Survey No.14, Hissa No.1 of the year 1963-64.  It is also pointed out by him that agreement of lease dt.20/8/1980 also depicts suit structures on the plot of land from City Survey No.165 (part).  In the case of Mahesh Nandlal Asrani Vs. BMC and ors. \''\''A.O. (stamp) No.11708/07\''\'' Hon\''ble Bombay High Court considered existence of old structure for a period of 30 years and granted temporary injunction till final disposal of the suit as existence of such old structure prior to datum line was found to be matter of evidence. Ld. Adv. for Deft No.2 has pointed out various discrepancies on the documents filed by Plff.  According to him Plff is showing documents of different structure to get relief from the Court.  As discussed herein earlier existence of structure is prima-facie proved by Plff by producing 7/12 extract, agreement of lease, agreement of leave and licence from the year 1963-64. As such this a fit case to grant ad-interim injunction in favour of the Plff.  Hence, ad-interim relief in terms of prayer clause (a) is granted till next date.

1. The plaintiff filed this application for continuation of earlier  order dated  26.03.2019.
2. Defendant No. 2 opposed application by filing detail reply below Exh. 11. It is stated that the order 26.03.2019 was obtained by the plaintiff by playing fraud and on the  basis of fabricated mutation entry. Therefore the plaintiff who obtained order by playing fraud is not entitled for any relief.

4. On perusal of the roznama it appear that 26.03.2019 this court granted ad-interim relief on the ground that the structure is in existence since prior to 1962 and this court has relied upon 7/12  extract of survey 14/1.  Advocate for defendant No. 2 submitted that Talathi of Village Turbhe by letter dated 20.12.2022 informed that M.A.NO. 132 do not pertains to survey No. 14/1. The plaintiff has today produced on record 7/12 extract of survey 14/1. The 7/12 extract of survey No. 14/1 produced by plaintiff itself shows that M.A. No. 132 is not in respect of recording name of V. Gopalan to survey No. 14/1. Thus photocopy of 7/12 extract of survey No. 14/1 annexed by the plaintiff             to the plaint, appears to be doubtful and fabricated. Therefore I find substance in submission of Advocate for defendant No. 2 that  plaintiff obtained ad-interim order by playing fraud and on the basis of fabricated documents.  It is well settled that the person whose case is based on fraud is not entitled equitable relief.  In the circumstances and in view of the judgment relied by the defendant No. 2, application for continuation of earlier order deserve to be rejected. hence I passed following order.
