This is N.M. of defendant for condonation of delay and for order to meets ends of justice.
Perused affidavit of Ramnik Lal Shah. The defendant claiming that the lease rent has been paid in respect of 14800 sq feet land at the rate of 6.00 paisa per sq feet. The clarification is required that agreement of lease for 14800 sq feet of land to be executed in favor of the defendant by the plaintiff no.03. In the affidavit of Dipti Gandhi it is submitted that only land ad-measuring 741.01 sq meter was proposed to be lease out to the society.
I heard both side. Perused common written argument of defendant in N.M. 3269 /17 and N.M. 799/18. There is no force in submission of argument as the defendant contested the suit. In view of written statement Exh-86 being a pleading of the defendant society required to be construed strictly being a suit filed before Hon High Court. Thus on relying upon the written statement I hold that
N.M. 799/18 is deserved to be rejected
