Adv. Kolge insisted to grant ad-interim relief.  According to him the  plaintiff is also having a decree passed by the Small Causes Court in his favour against the tenant Ajit Ketkar in respect of the suit premises where at the time of execution the def. no. 1 found in possession of the suit premises and consequently the plaintiff has taken out proceeding for removal of obstruction and the same is pending part heard before the Small Causes Court for cross examination of obstructionist who is def. no. 1 here.  Adv. Kolge apprehends that the def. no. 1 may create third party rights in the suit premises.  The present suit has been filed seeking declaration that the deed of transfer executed by the def. no. 2 who is co-owner of the suit premises in favour of def. no. 1, is null and void  and not binding on the plaintiff etc.
  Considering these facts, it is necessary to allow  both the defendants to file their replies/w.s. on the point under what circumstance the impugned deed of transfer was executed.
