Ld. counsel for plaintiff pressed for passing ad-interim order in view of the apprehension stated in the paragraph no. 4 of the plaint that the defendants no. 3 to 18 are agitating about their dispute and are likely to create nuisance by collecting 30 to 35 people including office bearers of defendant no. 1 and 2 and forming unlawful assembly. Hence, he urged that though service of the NM is effected on the defendants, he wants time to file affidavit of service and in the meanwhile the defendants present before the court be restrained by passing ad-interim order.
After hearing both the sides, considering the apprehension of the plaintiff and to maintain law and order, I am of the view that it will be proper to grant time to the defendants to submit their reply affidavit with a directions that the defendants no. 3 to 9, 11 to 13, 15 and 16 and Shri Tanaji Pise, representative of defendant no. 1 and 2 to maintain peace and not to take law in their hands and not to create any nuisance or create obstruction to the peaceful operation of the plaintiff company at suit site/premises till next date.
Sheristedar to provide authenticated copy of today\''s roznama to the Ld. counsel for plaintiff for information and communicating the same to the defendant for the compliance.
