1. By this Notice of Motion defendant No.1 has prayed for
condonation of delay and grant of permission to written statement on
record.
2. The Ld. Counsel for the plaintiff resisted the contentions of
defendant by contending that delay is not properly explained and
prayed for rejection of the Notice of Motion.
3. Heard the rival parties. Perused Record & Proceeding. It
reveals that written statement is already on record but, it is not

exhibited as defendant did not take an appropriate steps. It is well
settled that every matter should be decided on merit and for that
purpose, defendant deserves to be allowed to take written statement on
record. Hence, I am of the view that delay deserves to be condoned
with permission to defendant No.1 to take an appropriate steps to take
written statement on record. With this, I proceed to pass the following
order:
ORDER
1. Draft Notice of Motion in S.C. Suit No.1578/2018, is hereby
allowed, in terms of prayer Clause (a) & (b).
2. Draft Notice of Motion be sent to concern Department for
registration for statistical purpose.
3. Draft Notice of Motion stands disposed off accordingly.
