Perused the chamber summons which is supported by an affidavit of Deepak Mengar. The plaintiff is public charitable trust registered under the provisions of Maharashtra Public Trust Act 1950. It is submitted that as per change report Exh.A the names of new trustees are brought on record. On account of subsequent changes during the pendency of suit, it is necessary to bring on record the new trustees, being necessary party under Order 1 Rule 10 of the CPC. Hence, I pass the following order.
                                           ORDER
Chamber Summons No. 1057/21 is allowed and made absolute interms of prayer clause (a) and (b). The applicant to carry out the amendment within two weeks and shall serve the copy of amended plaint upon the defendants within two weeks thereafter. Chamber Summons is disposed of accordingly.
