The NM is pending since 2021 filed by defendant to condone the
delay of 317 days to file written statement. The NM is supported
by affidavit of defendant. The plaintiff has filed reply and
objected on the ground that the sufficient cause is not shown to
condone the delay. There is a common ground of Covid 19 hence
prayed to reject the NM .
The NM is filed on 10/02/2021. During the said period there was
Covid 19 Pandemic. The suit was filed 06/02/2020. During the
month of March 2020 till 28 February 2022 was a Covid 19
Pandemic Period. Therefore the delay needs to be condoned in
view of Suo-moto petition by Hon’ble Supreme Court wherein the
limitation period is excluded. Hence the NM No. 414/2021 is
made absolute as per prayer (a) by condoning the delay.
The written statement of defendant No. 1 is taken on record and
marked as Exh.7. O- Read and recorded.

The NM is pending since 2020 filed by plaintiff seeking
temporary injunction pending disposal of the suit. The defendant
no.1 filed reply to the said notice of motion on 03/05/2020. The
plaintiff as well as defendants are not appearing since long. The
NM is pending since 2020 for hearing. The suit is filed for
partition and separate possesion. It seems that both the parties
are not interested to proceed with NM. Hence NM is disposed of.
Matter is adjourned to 19.09.2026 for steps to serve the
remaining defendants/dismissal order against those defendants.
