Plaintiff submitted that, in terms of consent terms Exh.3 dated 17/03/2019, matter is settled between
Plaintiff and Defendant no.2 and therefore Plaintiff is intending to withdraw the suit against
Defendant no.1/BMC. VERIFICATION ABOUT WITHDRAWAL PURSIS EXH.2 Plaintiff with
advocate Ms. Neha Pandey. Plaintiff submitted that, he is withdrawing the suit unconditionally
against Defendant no.1/BMC, hence verified. VERIFICATION ABOUT CONSENT TERMS
EXH.3 Plaintiff present with advocate Ms.Neha Pandey. Defendant no.2 present along with
advocate Ms. Rushita Jain. Plaintiff and Defendant no.2 submitted that they have signed
Memorandum of Understanding and consent terms after understanding contents of Memorandum of
Understanding and consent terms. Further, they have submitted that they admit the contents of
Memorandum of Understanding and consent terms, hence verified. ORDER BELOW EXH.1 1.
Plaintiff has withdrawn this suit against Defendant no.1/BMC unconditionally vide withdrawal
pursis Exh.2, hence suit stands disposed off as withdrawn against Defendant no.1/BMC. 2. Suit
stands disposed off against Defendant no.2 in terms of consent terms Exh.3. 3. Draft Notice of
Motion also stands disposed off accordingly. Draft Notice of Motion be registered for statistical
purpose.
