The order dtd.24.01.2018 passed by Ld.CMM is under challenge in this suit. By this NM, plaintiff is seeking ad-interim relief for stay to execution and operation of  that order dtd.24.01.2018.
       Perusal of order dtd.24.01.2018 shows that by said order, Ld.CMM has appointed Court Commissioner to take possession of secured asset, more particularly described in para 2 of the said order.
       Perusal of orders produced by Deft. bank during the course of argument show that action under Sec.14 of SARFAESI Act is already initiated by Deft bank against plff. It further shows that one Dr.Bharati Magoo and the tenant namely Mohd. Wahid have already challenged this action of bank before DRT as well as in RAD before small Causes Court, Mumbai.
