Perused contents of plaint, documents annexed thereto and heard bothsides.
The subject matter of this suit is a plot of land having structure standing thereon admeasuring above 777 sq. mtr. situated at CTS No.305, 306, 310, Survey No.48, Hissa No.4 (part) of village Kirol, Taluka Ghatkopar, Mumbai.  The Plff is praying for ad-interim relief restraining Deft/MCGM from taking any coercive action against the said plot without following due process of law. Ld. Adv. for Deft/MCGM points out that the notice u/s.314 of MMC Act is issued to the Plff on 8/2/18 for construction of ground floor structure which needs to be removed for road widening of LBS Marg.  However, after careful reading the said notice it is only given for the structure and not the whole plot admeasuring 777 sq. mtr.  The Deft/MCGM has not shown any document showing that it has commenced procedure laid down u/s.296 of MMC Act of Acquisition of Land for road widening.  As such, Plff is entitled for ad-interim relief.  Hence, ad-interim relief in terms of prayer clause (a) is granted till next date.
