Heard the Ld. adv. for appellant and Ld. adv. for respondents on the ad interim stay requested in the application Exh.3. The Ld. adv for appellant submits the impugned order is likely to be executed and in that case appellant would have to lose the possession and the purpose of filing of the appeal would get frustrated and therefore, he submits that ad-interim protection may be granted to the possession. The Ld. adv. for respondent has submitted that sufficient opportunity has been given to the appellant but he has failed to contest the matter before the inquiry officer who has passed the impugned order of eviction of the disputed premises. Therefore, he has opposed the aforesaid request. In view that the matter should be decided on merits after completion of pleadings of the parties on the stay application, I think no prejudice would be caused to the respondent if for some period the execution of the impugned order is stayed. Hence, there shall be ad-interim stay to the impugned order till next date. The Matter is adjd. to. 28.03.2019 for reply of the respondents to the stay application Exh.3.

ORDER
1. Misc. Appeal is dismissed.
2. Time is granted to the appellant/s to vacate the premises till 30/04/2024 subject to appellant/s filing an undertaking before this Court within 4 weeks from today that the appellant/s is/are in physical occupation of the premises and that appellant/s will not create any third party interest in the said property and further appellant/s will honour the order of the learned Enquiry Officer on its attaining finality.
3. If the above undertaking is/are not filed within the stipulated period, the execution can be proceeded with.
4. Record and proceedings be returned to the Respondent No.1/BMC.
5. Application under Order XLI Rule 27 of CPC is rejected.
6. All Misc applications stand filed in view of disposal of appeals.
