The plaintiff was allowed to serve to summons through bailiff by the order dated 29.11.2022. However, it is not appearing that the plaintiff has made any attempt to serve the summons. The plaintiff did not file the service affidavit, though the matter was adjourned thrice. Therefore, matter was posted today for dismissal order.
Today, the plaintiff moved the application for substitute service (Exh-6). The application is not supported by the affidavit and even it is not signed by the plaintiff. Such incomplete application for substitute service cannot be entertained and needs to be rejected. Furthermore, the case is not matured for permitting the plaintiff to serve the summons by way of substitute service, particularly when the plaintiff has not taken steps for serving the suit summons through the bailiff, as per the permission sought by him. Therefore, there is no question to allow the application (Exh-6) and even, the application (Exh-5) moved for removal of the caption dismissal. Hence, both the applications (Exh-5 and 6) is hereby rejected. However, in view of the request of the plaintiffs counsel that the plaintiff wants to take the steps positively on the next date, the matter is adjourned in the interest, subject to costs of Rs.2,000/- payable to DLSA.
