to chamber summons No. 405/20. t.o.r. ORDER below
chamber summons No. 405/2020 Chamber summons is
filed by plaintiff to implead legal heirs of plaintiff expired
on 11.12.2019. The chamber summons is supported by
affidavit of Devesh Batta. The defendant filed reply and
stated that the court may pass necessary order to allow the
joining of shares and legal representatives of plaintiff. The
suit was filed by deceased plaintiff thereby restraining
defendant from dispossessing him from suit property and
other consequential reliefs. There was covid-19 pandemic
situation in the country for about one and half years. Still
the said situation has not overcome. The court regularly
started working from 02.08.2021. Considering the nature of
suit and as the defendants have no objection to bring on
record legal heirs of plaintiff therefore pass following order
ORDER 1. The Chamber summons is allowed. 2. The
prayer (a) and (b) of chamber summons is allowed 3.The
plaintiff to carryout necessary amendment within limitation.
4. Accordingly, Chamber Summons is disposed of.
