O R D E R
Applicantion has been preferred for directing the concerned Birth
Certificate Issuing Authority to issue Birth Certicate of the child, Nidhi
Wadhwani on the ground that due to inadvertance while passing order
dated 30.01.1989 in Misc. Petition No. 10/1989, the then presiding
officer has not given direction to issue Birth Certicate of the child, Nidhi
Wadhwani (female, DOB – 25.12.1987).
2. Perused the application and documents filed on the record, more
specifically the order dated 30.01.1989 in Misc. Petition No. 10/1989.
Heard advocate for the applicant.
3. From the perusal of order dated 30.01.1989 in Misc. Petition No.
10/1989, it is evident that the petitioner had filed Misc. Petition No.
10/1989 in the matter of adoption of the child, Nidhi Wadhwani

(female, DOB- 25.12.1987) and the said petition was allowed and
disposed of. The child, Nidhi Wadhwani (female, DOB – 25.12.1987) is
given in adoption to the petitioner but due to inadvertance while
passing order dated 30.01.1989 in Misc. Petition No. 10/1989, the then
presiding officer has not given direction to issue Birth Certicate of the
child, Nidhi Wadhwani (female, DOB – 25.12.1987).
4. Under the facts and circumstances, Birth Certificate needs to be
issued in the name of the child, Nidhi Wadhwani (female, DOB –
25.12.1987) by showing name of the petitioner, Mr. Shyam Wadhwani
as father and name of his wife, Mrs. Kajal Wadhwani as mother of the
said child. In the result, application is liable to be allowed. Hence this
Court proceeds to pass the following order :-
O R D E R
1) Miscellaneous Application No.42 of 2020 is allowed and disposed
of.
2) Concerned Birth Certificate Issuing Authority is directed to issue
Birth Certificate in the name of the child, Nidhi Wadhwani (female,
DOB – 25.12.1987) showing name of the petitioner, Mr. Shyam
Wadhwani as father and Mrs. Kajal Wadhwani as mother of the said
child within 15 working days from the date of application.
