Advocate Mr. Hardik Sajnani for Defendant no.1 present and filed
draft Notice of Motion with affidavit in support of Notice of
Motion for condonation of delay caused in filing Written
Statement. Leave to register Notice of Motion is granted. Copy of
Notice of Motion be served upon other side.
Plaintiff's advocate submitted that Plaintiff is not intending to file
any reply to the Notice of Motion and Plaintiff intends that all the
pleadings of Defendant should come on record so that the suit will
be decided on merits.
As Plaintiff has not strongly resisted Notice of Motion I find that
delay caused in filing Written Statement by Defendant can be
condoned because admittedly Written Statement was affirmed in
the year 2016 itself. Hence, I proceed to pass following order
ORDER
1. Draft Notice of Motion taken out by Defendant No.1 is made
absolute in terms of prayer clause (a) of the Notice of Motion.
Defendant no.1 is directed to file Written Statement on next date
without fail.
2. Draft Notice of Motion be registered for statistical purpose.
Case is adjourned to fixed date.
