Order passed below Ch/s no. 564/19 This Ch/s has been taken out by the Plaintiff for allowing the
plff to amend the plaint. Adv for Defendant no. 2 has submitted to the court and there is no reply
tendered by Defendant no. 2. Perused proposed amendment. It appears that after filing of this suit as
Defendant no. 1 entered into a supplementary development agreement dtd 23.4.2015 with
Defendant no. 2 and agreed to allot new flats in lieu of existing flats of the members of Defendant
no. 1, the Plaintiff wants to carry out proposed amendment. Thus, considering event occurred
during the pendency of the suit in respect of suit subject, it is just and proper to allow present Ch/s,
in the interest of justice. Hence, Ch/s is made absolute in terms of prayer clause (a) and (b). The
Plaintiff is allowed to carry out amendment as prayed within two weeks from the date of this order
and further directed to place on record amended copy of the suit plaint and furnish the same to the
Defendants. Accordingly Ch/s. no. 564/19 stands disposed of. Matter is adjd. to 12.07.2019 for
compliance.
