Perused the chamber summons which is supported
by an affidavit. As per order dtd. 15.03.2021, the
chamber summons is proceeded without reply of
defendant. I have perused the proposed
amendment, it is submitted that only the name and
address of plaintiff company is changed from
Emgee Homes Private Limited to Level
Constructions Private Limited. The document Exh.A
annexed with the affidavit in support shows that
Ministry of Corporation Affairs, pursuant to Rule 29
of the Companies Incorporation Rules as issued the
certificate of incorporation after change of name of
company. Thus inview of document Exh.B, it is
necessary to allow the said amendment. The
proposed amendment is not going to change the
nature of suit but is necessary for continuation of
the suit. Hence, I pass the following order ORDER
Chamber Summons No. 410/2020 is allowed and
made absolute interms of prayer clause (a) and (b).
The plaintiff to carry out amendment within four
weeks. Chamber summons is disposed of
accordingly.
