PAVASKAR (C.R.NO.12) DATE : 15th JANUARY 2021 ORAL ORDER The plaintiff has taken out this chamber summons for issuance of directions to the respondent to produce the death certificate of the deceased defendant No.1 and to disclose the names and addresses of her legal heirs. Page 1 of 3 -- 1 of 3 -- CS No.409-2020 2. Heard learned Advocate for the plaintiff. Perused chamber summons and affidavit in support thereof. 3. From the affidavit, it appears that the notice issued by the plaintiff to defendant No.1 was returned with postal endorsement “Addressee has expired”. The plaintiff has, therefore, taken out this chamber summons for issuance of directions to the respondent to produce the death certificate of the deceased defendant No.1 and to disclose the names and addresses of her legal heirs. However, from the endorsement on the postal envelope of the notice issued to defendant No.1, it appears that he has also expired. As a corollary, the chamber summons does not survive and has become infructuous. Hence, the order:- ORDER 1. Chamber Summons No.409 of 2020 is dismissed. 2. No order as to costs. 3.
