Ld. Adv of plaintiff has filed this application to permit him
to withdraw the suit as the Appeal From Order No.398 of 2026
before the Hon’ble High Court came to be disposed of on
25.03.2026. Considering the above circumstance, plaintiff does
not wish to proceed and allow him to withdraw the same.
As against, the defendant has filed reply, objected the
same, saying that, plaintiff has harassed to the defendant by one
or other pretext. Therefore, cost may be imposed or his
application may be rejected.
Heard argument. Perused record.
It appears, plaintiff has preferred an Appeal from Order
No. 398 of 2026, which came to be disposed of 25.03.2026. As
plaintiff does not wish to proceed in the circumstances, it would
be appropriate to allow the plaintiff to withdraw the suit and
accordingly, plaintiff is allowed to withdraw the suit and finally
disposed of. Court fees be refunded to the plaintiff as per rules.
