     Ld. Counsel appearing on behalf of deft. submits that he has no objection for registration of suit as Short Cause Civil Suit.
      Perused the plaint.  It is contended that plaintiffs have agreed to purchase suit flat from deft. for consideration of Rs.64,50,000/-. Accordingly, memorandum of understanding was executed between the parties.  Suit property is the residential flat situated in Shradha Co-Op. Housing Society, Vikhroli (East).  Plaintiff is claiming for specific performance of the agreement dated 01.01.2019.  Said agreement is not with respect to immovable property used exclusively in trade or commerce.  Plaintiff in para no.17 of the plaint specifically pleaded that his suit does not fall within the provisions of Commercial Courts Act.  From pleadings in the plaint, it is clear that present dispute is not a dispute as defined in Section 2(c) of the Commercial Courts Act.  Present suit does not qualify as a Commercial dispute.  Therefore, matter be sent to the Office of Registrar (Civil) for further assignment.   Application (Exh.8) is disposed of accordingly.

From the document on record one leave and license agreement is also filed and it is submitted that certain orders were passed by the Competent and Appellate authorities. Without going into the merits on NM, at this stage considering overall facts and circumstances of the present case,  I am of the opinion that parties to the suit may be benefited if the matter is referred to the Mediation. Both the parties and respective  advocates have consented for referring the matter to the mediation. As per Sec-89 of the CPC, this matter is referred to the Mediation. Considering the fact that the plff is in possession of suit premises and also considering his apprehension as regard the orders of competent authorities, it is necessary that there should be a time bound mediation. The learned co-ordinator is requested to allot this matter to the Judge Mediator. The learned Judge Mediator is requested to complete the Mediation within 10 days considering the urgency.
